I am requesting the following information:

A copy of each monthly data submission from the trust to GDNRSS/Arden and GEM CSU relating to the operation of your GIC for the period 2023/07/01 to present.

Response sent

The Trust confirms that it holds the GIC monthly submissions to GDNRSS you have requested. We have engaged s22 of the Freedom of Information Act 2000, (Information is held with a view to publication at a future date), as we plan to publish GIC performance data sets around April 2025, once the current financial year has closed, and will not be issuing more performance data for any new requests until this time.

In the meantime, please be assured that the Trust is not withholding this data where it has already been published by other means, such as previous responses to applicants, and past requests and responses in the Trust’s FOI Disclosure Log, which can be reached via this link: FOI Disclosure Log from April 2016 to present – Tavistock and Portman

Since April 2020, the Trust has responded 57 FOI requests for data, specifically related to GIC Performance Delivery, ie the data contained in the reports you have requested under the Trust’s monthly submission to GDNRSS and these are publicly available. In order to be helpful to you between now and the April publication date, we have prepared an extract from the Trust’s disclosure log , in tabular form below, summarised the categories of GIC performance data requested, and below that supplied another table with reference details and links for each of these requests and answers. We hope that you will find these helpful, in the meantime.

Under section 22 of FOIA 2000 the Trust is not obliged to provide information intended for future publication, subject to the outcome of a public interest test, which weighs up whether the public interest in disclosing the information now, outweighs the public interest in withholding it until its publication date. (NB: Public interest is defined here as the public good, and not what is of interest to the public, nor the private interests of the requester.)

In line with the terms of this exemption, we weighed up whether it would be in the public interest for us to provide or withhold the requested monthly submissions

We took into account the following factors:

Public interest considerations favouring disclosure:

• Disclosure would provide increased transparency via release upon request of any incremental GIC past performance data
• Disclosure of the information under FOIA would be consistent with the Trust’s intentions to proactively release data on matters of a wider public interest.

Public interest considerations favouring withholding the information:

• It is in the public interest that the Trust’s new publication schedule for GIC performance data plan allows the Trust time to plan and publish this data alongside any new explanatory notes detailing if/how future performance might be impacted by any new developments .
• It is in the wider interest that information is accessible to the public domain by adhering to the Trust’s publication schedule, to ensure that it has adequate time to complete all planned related activity prior to final publication
• Whilst there is a public interest in providing information within scope of an FOI request as quickly as possible, this needs to be balanced with the public interest in ensuring the data can be accessed simultaneously by the general public rather than piecemeal by disclosure to a small number of applicants under FOIA.

We have concluded that, on balance, the public interest is in withholding this information.
