Response to Questions 1-6: The Trust confirms that it holds the data you have requested in Questions 1-6 above.. We have engaged s22 of the Freedom of Information Act 2000, (Information is held with a view to publication at a future date), as we plan to publish GIC performance data sets around April 2025, once the current financial year has closed, and will not be issuing more performance data for any new requests until this time. This is explained further below the following tables.
In the meantime, please be assured that the Trust is not withholding this data where it is already publicly available and has been published by other means, such as previous responses to applicants, and past requests and responses contained within the Trust’s FOI Disclosure Log, which can be reached via this link: FOI Disclosure Log from April 2016 to present – Tavistock and Portman
Since April 2020, the Trust has responded 57 FOI requests for data, specifically related to GIC Performance Data, (ie the data contained in your Questions 1-6 above,) so in order to be helpful to you between now and the April publication date, we have prepared below an extract from the Trust’s disclosure log. Under section 22 of FOIA 2000 the Trust is not obliged to provide information intended for future publication, subject to the outcome of a public interest test, which weighs up whether the public interest in disclosing the information now, outweighs the public interest in withholding it until its publication date. (NB: Public interest is defined here as the public good, and not what is of interest to the public, nor the private interests of the requester.)
In line with the terms of this exemption, we weighed up whether it would be in the public interest for us to provide or withhold the requested monthly submissions
We took into account the following factors:
Public interest considerations favouring disclosure:
- Disclosure would provide increased transparency via release upon request of any incremental GIC past performance data
- Disclosure of the information under FOIA would be consistent with the Trust’s intentions to proactively release data on matters of a wider public interest.
Public interest considerations favouring withholding the information:
- It is in the public interest that the Trust’s new publication schedule for GIC performance data plan allows the Trust time to plan and publish this data alongside any new explanatory notes detailing if/how future performance might be impacted by any new developments .
- It is in the wider interest that information is accessible to the public domain by adhering to the Trust’s publication schedule, to ensure that it has adequate time to complete all planned related activity prior to final publication
- Whilst there is a public interest in providing information within scope of an FOI request as quickly as possible, this needs to be balanced with the public interest in ensuring the data can be accessed simultaneously by the general public rather than piecemeal by disclosure to a small number of applicants under FOIA.
We have concluded that, on balance, the public interest is in withholding this information until the planned publication data.

- Causes of Death –It is important to note here the deaths reported above indicate the number of patient files closed due to their death. They were not all necessarily related to care provided or omitted by the Trust, and where they are, they are managed through the Trust’s mortality review process.
The Trust is withholding data on individuals’ ages, dates and causes of death for each of the deceased as this could lead to identification of individuals through triangulation of publicly available data from other sources.
Furthermore we would like you to know that the Trust did consider grouping ages for each of the years requested and releasing the results to you, but this still resulted in the band numbers being equal to or less than 5 in all but one age band. (Initially we looked at the age bands 17-24, 35-44, 45-54, 55-64 and 65+, and then at a wider band of ages 17-44, 45-64, and 65+)
It is the NHS Digital standard not to provide data where the numbers are smaller than 6 as this may lead to identification of individuals. For this reason and in accordance with The Common Law Duty of Confidentiality, which restricts the identification of individuals who may have received services from the Trust. This it is fundamental to the way the NHS operates, and extends beyond the death of individuals:
The data in question may already be publicly available under other legal regimes
- Whilst there is no equivalent statutory provision in relation to social care records, local authorities generally provide access to social care records through the Freedom of Information Act.
- Whenever inquests are held, linked to a Prevention of Future Deaths report (Regulation 28 Report to Prevent Future Deaths), the name of the deceased is published and placed into the public domain by a coroner, though this does not cover every death in the country.
- The data you seek might be reachable via either of the following publicly available links; one shows data by name of the deceased, and the other shows a listing by Trust.
- Reports to Prevent Future Deaths – Courts and Tribunals Judiciary searchable by deceased’s name, and includes where an organisation may have responded
- Reg 28 Reports Tracker Database – Preventable Deaths Tracker searchable by any of the fields which can be sorted into alphabetical order, by clicking on any column header. Also available for reuse as a purchase.
The Trust recognises a high level of interest from public in how the public purse is spent on services, and must balance this against disclosure of small numbers and the years in which the deaths occurred, which – whilst not directly identifying individuals, would nevertheless give rise to a disclosure of personal data, as follows:
- As we are a small Trust there is a high chance of recognition/identification of particular individuals/patients from the low numbers.
- This masking of low numbers is not a just a question of considering the means reasonably likely to be used by general public, but also the means likely to be used by a determined person with a particular reason to want to identify individuals from data in the public domain now or in the future, and/or gained from other sources.
Furthermore, the Common Law Duty Of Confidentiality restricts the identification of individuals who may have received services from the Trust, and extends after the death of individuals. For more details on this please click on this link: Section 2: The Common Law of Confidentiality and Consent . This means that when an individual has died, information relating to that individual remains confidential under the Common Law, by which all NHS Trusts abide.. The key principle is that information confided should not be used or disclosed further, except, as originally understood by the confider, or with their subsequent permission.
The Trust fully recognises that the information you have requested might already be in the public domain, published under different legal framework/regimes. This does not affect the Trust’s adherence to the principles of confidentiality after death, as set our above. Indeed, there are other Acts which permit certain authorities (but not the NHS) to reveal personal data of deceased persons under certain criteria, eg The Public Records Act 1958, confirms that an ethical obligation to the relatives of the deceased exists, and that health records of the deceased are public records and governed by the provisions of the Public Records Act 1958. The Access to Health Records Act 1990 permits the use and disclosure of the information within them in only limited circumstances, and permits access to the records of a deceased person by those with a claim arising out of that individual’s death, which is negated, however, if the deceased requested that a note denying access be included within the record.
In order to be helpful to you, we have provided below examples of potentially alternative sources where you might obtain the data for the year, age and cause of death details:
- There is no equivalent statutory provision in relation to social care records. Local authorities generally provide access to social care records through the Freedom of Information Act. However, the guidance issued by the Information Commissioner’s Office (ICO) on s.41 of the Freedom of Information Act (FOIA) means that relatives could pursue a case for breach of confidence ICO: Practical guidance: Information about the deceased).
- Another example could be that whenever Inquests are held, linked to a Prevention of Future Deaths report (Regulation 28 Report to Prevent Future Deaths), the name of the deceased will be published and placed into the public domain by a coroner. This does not cover every death in the country.

Response to Questions 9-10:
- MH Treatment offered to how many Waiting List patients at Gender Dysphoria Clinic 2019-24? (Q49-54)
The GIC is not commissioned to provide Mental Health care to patients on its waiting list. Patients who call or who contact the service indicating Mental Health crises are referred to an appropriate Mental Health provider in primary or secondary care, and a note would usually be made to this effect on their file to record this contact.

Please refer to the Trust’s response to Question 9 above.
We confirm that this data is held by the Tavistock and Portman NHS Foundation Trust and would be located in freetext notes sections within the waiting list patient’s electronic records. These are not currently in an electronic retrievable format, (ie there is no automated mechanism for the collation of the required data), and would require manual review and processing of a large volume of data, considerably exceeding the limit to time and resource provisioned under the Freedom of Information Act 2000 (FOIA).
The Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 has set the appropriate limit as £450 based on a generic charge of £25 per hour to determine whether the Trust holds the information, to locate, and then to extract it). Section 12 of FOIA further states that the authority (ie this Trust) is not obligated to comply with a request for information if the authority estimates that the costs of complying with the request would exceed the appropriate limit.
We have estimated that to obtain the requested information, where held, would therefore require a manual search of all waiting list patient records amounting to over 15,000 electronic patient records, which, at an estimated 10 minutes per record would take approximately 2,500 hours. This means that as the time required to process this question falls outside the cost limit, this question is refused and exemption from disclosure has been engaged under s12 of FOIA.
Should you wish to narrow the scope of this question, the Trust would treat the submission as a new FOI request.
- Provision of Hormone Therapy from 2019-24: how many patients receiving psychological support from The Tavistock and Portman NHS Foundation were subsequently provided with cross-sex hormone therapy?
We have taken this question as a request for the number of GIC patients who were provided with cross-sex hormone therapy. The Trust does not hold this data.
The Endocrinology Team at the Trust’s GIC do not issue prescriptions for hormone therapy.
