The Tavistock and Portman NHS Foundation Trust is a small specialist NHS mental health trust with a focus on training and education, as well as providing a full range of mental health services and therapies for children and their families, young people and adults.

We provide daytime outpatient clinics, for mainly psychological services via talking therapies. We do not provide acute services, nor inpatient patient services, nor detention facilities, and do not have an A&E department

We noted you have already indicated “If your numbers are fewer than five, then use an asterisk.”, however we abide by the NHS England standard to include a mask for those numbers which are equal to or less than 5 as well as those fewer than 5, as this may lead to identification of individuals.

For this reason and in accordance with the Freedom of Information Act 2000 (FOIA) Section 40(2) and Section 40(3a) (Personal Data) disclosure of such low numbers constitutes a release of personal data or easily identifiable personal data and would thus be unfair, breaching GDPR Principle (a): Lawfulness, fairness and transparency. As this is an absolute exemption, we do not have to apply the Public Interest Test when engaging this exemption

Please kindly note that this masking of low numbers is not a just a question of considering the means reasonably likely to be used by general public, but also the means likely to be used by a determined person with a particular reason to want to identify individuals from data provided in the public domain now or in the future, and/or gained from other sources.

Furthermore, as we are a small Trust, there would otherwise be a high chance of recognition/identification of particular individuals by colleagues/patients or others from the low numbers so this is not just a question of considering the means reasonably likely to be used by general public, but also the means likely to be used by a determined person with a particular reason to want to identify individuals from data in the public domain now or in the future, and/or gained from other sources
