We can neither confirm nor deny whether the information you have requested is held by the Trust in its entirety. This is because the information requested is not held centrally, but may be recorded in individual patient records and individual staff-members’ activity plans.
We have estimated that it would take approx. 115 hours to answer this question because the information you are seeking for all parts of question 5d is not held in centrally an electronically reportable format, and would require an officer to conduct a manual trawl of 12 staff activity plans @ 1 hour each, and 100 patient activity files @1 to 1.25 hours each, to locate , extract, and cost out information by activity including any additional time for report writing and administration team time.
Accordingly, we are refusing this question under section 12 of the Freedom of Information Act (FOIA) on the grounds of cost, because our above estimation of time required to answer all parts of question 5d exceeds the “appropriate limit” of 18 hours set under FOIA.
- This limit, for answering a single FOI request, is set at £450 for authorities such as this Trust, which is equivalent to 18 hours at a generically set rate of £25 per hour
- The per hour figure is set by Regulations rather than actual salary paid to any officers handling requests.
- The appropriate limit includes the time it would take the Trust to discover if it holds the information requested, to locate it, and extract it – which would be in addition to putting it into a reporting format.
We hope you will understand that the Trust is therefore not obliged to respond to this question, so we will not be processing it further.
